ABSTRACT

The issue of recycling is particularly relevant where the yacht destined for scrapping contains hazardous materials that pose threats to the workers performing the breaking-up operations and/or to the environment. The 1989 Basel Convention and the 1995 Basel Amendment have created the basis for intervention in the sale of ships and yachts for scrap. Parties to the Convention are under a duty to take appropriate measures to reduce the generation of hazardous wastes to a minimum, and to ensure that there are adequate disposal facilities within the generating state. The general obligations under Article 1(2) also provide that the Ship Recycling Convention (SRC) does not restrict Contracting States from adopting more stringent measures in order to prevent, reduce or minimize adverse effects on human health and the environment. The text of the SRC is supplemented by an Annex containing the Regulations for the environmentally safe recycling of ships. .
