ABSTRACT

The Anti-Discrimination Act (Act), effective September 1, 2009, transposes pertinent EU legislation, applies to employment, and bans unequal treatment on the basis of sex, age, disability, race, ethnic origin, nationality, sexual orientation, religious affiliation, faith, or world view. It defines individual forms of discrimination and details the situations in which protection against discrimination is to be provided, how, and to whom. Harassment is considered discrimination and is prohibited. The Labour Code, No. 251/2006 Coll., requires the employer to ensure the health and safety of employees with regard to risks that may endanger life and health during work and to create a safe working environment. Act 2004-435 on Employment, as amended 2011, requires an employer who organizes, manages, and controls the performance of work to assure the observance of the principle of equal treatment of all employees and non-discrimination. Any form of discrimination of persons exercising their right to employment is prohibited in accordance with the Anti-Discrimination Act.
