ABSTRACT

Finland enacted a new Non-Discrimination Act (1325/2014), effective January 1, 2015, which increased requirements for preventing workplace discrimination and included an obligation to promote equality among employees and candidates. The employer must assess the realization of equality in the workplace and the needs of the workplace, taking into account the operating environment and working conditions. An employer shall be deemed to have discriminated if after receiving information that the employee has been a victim of harassment referred to above, he/she fails to take the steps to eliminate the harassment at their disposal. The Occupational Health and Safety Act, No. 738/2002, as amended, covers physical and psychological violence, including threats of violence, harassment, sexual harassment, and bullying. The Act of Equality between Women and Men No. 609/1986 (Act), as amended numerous times and in May 2011 prohibits gender-based discrimination and requires employers to treat employees equally.
