ABSTRACT

Act CXXV of 2003 on Equal Treatment and Opportunity No. 125/2003 implements European Union (EU) directives on anti-discrimination and equal treatment, prohibits discrimination, defines terms, and establishes requirements regarding employment. The New Hungarian Labour Code, entitled Act I of 2012 on the Labour Code, became effective on July 1, 2012, replacing the old law. It consists of two parts, with the first part regulating the enforcement of the new Labour Code and the second part amending 68 acts, including modifying Act CXXV of 2003 on Equal Treatment and the Promotion of Equal Opportunities. The Labour Code requires equal treatment and equal pay, prohibits direct discrimination, and refers to discrimination on sexual grounds. An employer must ensure conditions for healthy and safe work, although there is no legal definition of the actions that constitute sexual harassment or practical guidance as to the type of recovery which a victim of sexual harassment might seek.
