ABSTRACT

In Malta the Equal Treatment in Employment Regulations, puts into effect the principle of equal treatment in relation to employment by laying down minimum requirements to combat discriminatory treatment on any grounds. It is a defense for persons responsible for any institution where sexual harassment is alleged to have taken place to prove that they took such steps as are reasonably practicable to prevent such harassment. The Act defines discrimination based on sex or because of family responsibilities and includes the treatment of a person in a less favorable manner than another person has been or would be treated on the grounds of sex or because of family responsibilities. Persons who sexually harass other persons shall be guilty of an offence against this article and shall, without prejudice to any greater liability under any other law, be liable on conviction to a fine or to imprisonment of not more than six months or to both.
