ABSTRACT

The Netherlands Inspectorate SZW states that how an employee feels in the workplace does not only affect his/her performance, but also his/her health. If operating conditions, including psychological pressure and getting along with others, are not good, stress can arise. Stress is also called psychosocial workload (PSA). Factors that influence PSA and hence possibly also can cause stress are, for example: aggression and violence, labor discrimination, bullying, sexual harassment, and workload. The Working Conditions Act (WCA), 2007 replaced the WCA, 1998 and added the definition of psychosocial workload (PSW), which includes sexual intimidation, aggression and violence, and has been extended to include harassment and pressure of work. The General Equal Treatment Act (AWGB) Act of 2 March 1994, as amended in 2011, provides protection against discrimination on the grounds of religion, belief, political opinion, race, sex, nationality, heterosexual or homosexual orientation, or civil status. The prohibition of direct discrimination includes a prohibition on harassment and prohibits sexual harassment.
