ABSTRACT

In Romania Law No. 202/2002 on Equal Opportunities between Women and Men, forbids gender-based direct or indirect discrimination. Equal treatment and opportunities between women and men include non-discriminatory access to job vacancies, training, and working conditions, and equal pay for equal work value. Labour Code provides for the principle of equality of treatment in the labor field and prohibits any direct or indirect discrimination based on criteria such as sex, national origin, race, color, or ethnic origin. The code covers prohibition of forced labor, equal treatment, anti-discrimination, working conditions, human dignity, workers' rights, health and safety at work, and occupational health. An employee engaged in an occupation shall enjoy working conditions adequate to the activity carried out, social protection, health and safety at work, and respect for his/her dignity and conscience, without discrimination. The employer must ensure the health and safety of workers in every aspect related to the work but does not provide more specific provisions.
