ABSTRACT

The Code of Practice for the Spanish Labor Inspectors on Bullying and Violence at Work was approved by the Labor and Social Security Inspectorate for Labor Inspectors when enforcing health and safety regulations in the workplace, including harassment and violence in the workplace. The code considers work-related harassment and violence as behavior that could constitute a violation of both labor and occupational health and safety regulations. The principle of equal treatment between women and men means the absence of any discrimination, direct or indirect, on grounds of sex, the assumption of family obligations, and marital status. Royal Legislative Decree 2/2015, approved on October 23, 2015, amended the Workers Statute. The Spanish Penal Code, Organic Law 5/2010 of 22 June, which modifies the Organic Law 10/1995 of 23 November, of the Penal Code prohibits discrimination, includes racist motives as an aggravating circumstance in any offense, and penalizes incitement to discriminate, dissemination of abusive material, and the promotion of discrimination by associations.
