ABSTRACT

Amendments to the Labor Code of Ukraine, Law No. 322-VIII of 10/12/71, concerning in relevant part the harmonization of legislation in the sphere of combating discrimination, effective November 13, 2015, prohibit any discrimination in the workplace. The objective of the Law of Ukraine on Equal Rights and Opportunities for Women and Men, effective January 1, 2006, seeks to achieve equality of women and men by establishing a legislative base for securing equal rights and opportunities, and elimination of all forms of gender-based discrimination. An employer's conduct is regarded as discriminatory if the employer affords the worker advantages on the grounds of sex with regard to working conditions, establishing wages, fringe benefits and any other remuneration, promotions, transfers, or terminations. The following are not considered discrimination: special protection of women during pregnancy, childbirth, and breastfeeding; mandatory military service for men; different retirement age for women and men provided for by law; and positive action.
