ABSTRACT

The Anti-Discrimination Law, adopted on February 2010, bans discrimination on the grounds of gender, race, color, ethnicity, language, gender identity, sexual orientation, political, religious or philosophical beliefs. Albania was among the first countries in Europe to explicitly ban discrimination on the grounds of gender identity. Discrimination against a person in connection with his/her right to employment is prohibited. The employer is obliged also to raise consciousness about this law by posting it in the public premises of the workplace as well as enabling a full understanding of it by his/her own means or with the assistance of specialized subjects. The Gender Equality in Society No. 9970, 24.07.2008 law aims to ensure effective protection from gender discrimination as well as any other form of behavior that encourages gender discrimination. Any discrimination, harassment, or sexual harassment in the workplace by the employer and/or employee shall be prohibited. The employer is forbidden to carry out any action of sexual harassment against the employee.
