ABSTRACT

The Work Health and Safety Act 2012 became effective on January 1, 2013. The main object of this Act is to provide for a balanced and nationally consistent framework to secure the health and safety of workers and workplaces by protecting workers and other persons against harm to their health, safety, and welfare through the elimination or minimization of risks arising from work or from specified types of substances or plant; and providing for fair and effective workplace representation, consultation, co-operation, and issue resolution in relation to work health and safety. The South Australia Equal Opportunity Act 1984 covers grounds of unlawful discrimination in employment on grounds of sex, sexuality, marital status, pregnancy, race, age, physical and intellectual impairment, and sexual harassment. An act will be regarded as a discriminatory act despite the fact that the person alleged to have committed the act did so on the basis of a mistaken assumption.
