ABSTRACT

The China Employment Promotion Law (CEPL), effective from January 1, 2008, prohibits employment discrimination and permits employees to sue for employment discrimination on the basis of ethnicity, race, gender, or religious beliefs, but not age. Under the law, employers may not use gender to deny women employment or to raise recruitment standards for them. The CEPL also prohibits discrimination on the basis of physical disability and health conditions. The CEPL for the first time clearly grants Chinese job-seekers and employees the right to sue employers for discrimination in China's People's Courts. Its main purposes are to promote employment, create a fair employment environment, and prohibit employment discrimination. The Law of the People's Republic of China on the Protection of Rights and Interests of Women, 1992, as amended was amended in 2005 to prohibit sexual harassment of women. The law prohibits sex discrimination and sexual harassment, promotes equality between men and women, and requires equal pay.
