ABSTRACT

The Labour Protection Act B.E. 2541, 1998 as amended requires that an employer treat male and female employees equally in employment unless the description or nature of work prevents such treatment. An employer, chief, supervisor, or work inspector shall be prohibited from committing sexual abuse, harassment, or nuisance against an employee. Thailand's Gender Equality Act B.E. 2558, effective September 9, 2015, prevents discrimination on the basis of gender and includes lesbians, gay, bisexual, and the transgender people. "Unfair gender discrimination" means any act or omission of the act which causes the division, discrimination, or limitation of any right and benefit either directly or indirectly without justification due to the fact that the person is male or female or of a different appearance from his/her own sex by birth. Neither the workplace nor employer requirements are referred to in the Act.
