ABSTRACT

Legislation in 2014 on the prevention of psychosocial risks at work, comprising two laws and a Royal Decree, was published in the Belgian Official Gazette on April 28, 2014, and became effective on September 1, 2014. The legislation replaced the old procedures available to workers considered victims of workplace violence or harassment with procedures available to workers who suffer the deleterious effects of psychosocial risks in the workplace. The Belgian Federal Public Service (FPS) Employment, Labour, and Social Dialogue states that the objective of the legislation is to fight "psychosocial risks at work". Psychosocial risks at work should be included in the company's prevention policy as all other risks that may affect the health and safety of workers. The Welfare Act lists the general obligations all employers in Belgium, requiring them to take the necessary measures to promote workers' well-being, including the prevention of psychosocial risks at work, including stress, violence, harassment, and sexual harassment at work.
