ABSTRACT

Federal Law 9029/95, as amended prohibits discrimination in the workplace. Specifically, it prohibits the adoption of any discriminatory and restrictive practice relating to accessing or maintaining the employment relationship, for reasons of sex, origin, race, color, marital status, family status, disability, vocational rehabilitation, or age, except for protection of children and adolescents. The provisions of this Article shall not prevent the adoption of temporary measures aimed at the establishment of policies on equality between men and women. Federal Law 7716/89, as amended, defines crimes resulting from race or color prejudice. It establishes the Statute of Racial Equality, to ensure to the black population the realization of equal opportunities, protection of individual, collective, and diffuse ethnic rights, and combating discrimination and other forms of ethnic intolerance. Federal Law 7716/89, as amended by Law No. 9459 of 13 May 1997 provides for imprisonment of two to five years for those who deny or prevent someone's employment for racial discrimination reasons.
