ABSTRACT

The Workers Compensation Act, Occupational Health and Safety Regulation sets out the general duties of employers, workers, and supervisors to ensure or protect the health and safety of workers. This includes preventing and addressing workplace bullying and harassment. Policy D3-115-2 discusses employer duties regarding bullying and harassment. It identifies what WorkSafeBC considers to be reasonable steps for an employer to take to address the hazards of workplace bullying and harassment. The policy defines bullying and harassment as "any inappropriate conduct or comment that the person knew or ought to have known would cause the worker to be intimidated or humiliated". The definition covers conduct both of managers and co-workers, and excludes "reasonable" performance management and discipline. The term "mental stress" in section 5.1 of the Workers Compensation Act was changed to "mental disorder". A person must not engage in any improper activity at a workplace that might create or constitute a hazard to themselves or to any other person.
