ABSTRACT

The Law on Prevention and Punishment of Sexual Harassment aims to prevent and punish sexual harassment in relations of authority or dependence, whatever the legal form of this relationship. It defines sexual harassment as conduct of a sexual nature or other behavior with sexual connotation, which is unwanted or rejected by the person against whom it is directed and affects the dignity of the person. Article 5 sets out the essential elements constituting sexual harassment and states that it is the responsibility of the employer to keep the workplace free of sexual harassment by means which include training workers on rules and policies relating to sexual harassment, and investigating claims of harassment and reporting the results to the Ministry of Labor. Peru's Law on Health and Safety at Work, Law No. 29783, 2011 as amended, states that the employer must protect workers from various types of hazards, including psychosocial hazards, plan for, and control workplace hazards, including psychosocial hazards.
