ABSTRACT

The Protection from Harassment Act, effective April 27, 2013, provides for the issuing of protection orders against harassment and affords victims of harassment with an effective remedy against such behavior. The Employment Equity Amendment Act, Act No. 47 of 2013 and Employment Equity Regulations, 2014 became effective on August 1, 2014, with the 2014 regulations replacing the 2009 regulations. The Act and regulations apply to all employers and workers and protect workers and job seekers from unfair discrimination. The Promotion of Equality and Prevention of Unfair Discrimination Amendment Act, 2000 gives effect to the Constitution of the Republic of South Africa, 1996, so as to prevent and prohibit unfair discrimination and harassment. The objective of the Code of Good Practice on Handling Sexual Harassment Cases, 2008 is to eliminate sexual harassment in the workplace. It is intended to guide employers and employees and sets out the best ways to deal with complaints about sexual harassment.
