ABSTRACT

The Law on Turkish Human Rights and Equality Institution, No. 6701, effective April 20, 2016, forbids discrimination based on gender, ethnicity, nationality, skin color, language, religion, philosophical or political opinion, wealth, birth, marital status, medical condition, disability, or age. An administrative fine of minimum TRY 1,000 and maximum TRY 15,000 is prescribed for violation of the law. The law is applicable to employment contracts not within the scope of the Turkish Employment Law No. 4857. Other exclusions are also set forth. Turkish court sets precedent in favor of mobbing victim: An April 16, 2014 Turkish court ruling made clear that it is the employer, rather than the employee, who must prove that harassment did not take place. A banker whose contract was annulled by a bank in Izmir, for which he worked from 1994 to 2010, filed a complaint demanding non-pecuniary damages and overtime payment.
