ABSTRACT

Care must become an explicit component of the family justice system. In Chapter 3, the authors establish that caring is an essential element of human relationships and that it is a social obligation. As such, family courts assume the responsibility to care. In this chapter, the authors maintain that effective justice for families cannot occur without including an explicit care ethic in the court’s work. Chapter 3 describes the ethic of care, its historical roots, and how it has evolved to become an essential component in the administration of justice.
