ABSTRACT

This introduction presents an overview of the key concepts discussed in the subsequent chapters of this book. The book focuses on an academic legal analysis of some of the issues surrounding the debt crisis; the significance of political and moral considerations in the context of debt repayment cannot be ignored. It is written with the intention of strengthening the arguments against debt repayment by giving them a legal basis, and it aims to challenge the logic according to which creditor claims stand above all other considerations. The book provides some background information regarding the history of Argentina's sovereign debt, and the internal and international political and economic context in which it was contracted and restructured. It examines possibilities to repudiate sovereign debt under the international law doctrine of odious debts. The book addresses constitutional arguments on the basis of which the validity of the debt can be challenged.
