ABSTRACT

This chapter examines the general activities performed by the Security Council and General Assembly to safeguard fundamental global interests. It illustrates the parallel, simultaneous activity performed by the Court to achieve the same goals, as an interpreter of the pressing needs created by globalization. The International Court of Justice (ICJ) takes great care in establishing a cooperative relationship with the UN and other international institutions. In the most recent judgments and opinions the Court quite clearly equated the UN with the international community. The Court promotes a concentration of the global functions in a public international organization, such as the UN, and fosters the creation of a balance of powers between the organizations organs to ensure international legality. The Courts ascertainment of violations of fundamental obligations by way of advisory opinions and its provisional activities to safeguard peace do not contradict one another but are rather complementary to the Councils activity pursuing the Charters objectives.
