ABSTRACT

Abortion legislation is a way of defining Frances relationship to Europe, and Europe's relationship to the rest of the world a way of defining in a quite elementary way whether or not a nation state is part of the Western project. The passage on the European Court of Human Rights operates according to the same assumptions. The International Criminal Tribunal for the former Yugoslavia (ICTY) sought to formulate judgments that would re-establish Bosnian women's wombs as national space and that would re-establish the criminal, regulated nature of sexual behaviour. Other forms of sexual violence against refugees exist, however, that are more closely correlated to the specific and rectifiable participation of state, IGO, and NGO actors in the provision of humanitarian assistance. Both pregnancy and sexual activity are linked to human immunodeficiency virus (HIV), producing an association between sexuality and reproduction on the one hand and individual or collective illness or death on the other.
