ABSTRACT

The Court determined that the Constitution protects a woman's decision whether or not to terminate her pregnancy. There have been a series of court rulings that have determined physical boundaries around both clinics and the people entering and exiting such spaces. Through these rulings, a series of definitions have emerged that codify the spatial relationships about abortion and public space as they pertain to the First Amendment. In 1959, the American Law Institute (ALI) advocated legalizing abortion for reasons that would include the mental or physical health of the mother, pregnancy due to rape or incest and fetal deformity. The Supreme Court upheld the 1993 Colorado measure protecting those seeking abortion from harassment taking a prophylactic approach. Reacting to aggressive and confrontational tactics by anti-abortion protestors that had often impeded access, the Boulder City Council passed the first bubble law in 1986.
