ABSTRACT

This conclusion presents some closing thoughts on the concepts covered in the preceding chapters of this book. The book examines documented cases of criminalization following aviation accidents which is a high-profile area of enormous importance. It explores the interaction between the intermingling of the technical and judicial investigations and the effect of criminalization on aviation safety but it has the limitation that the methodology does not permit statistical extrapolation. The book discusses the problems of managing complex aviation accident investigations and the court proceedings that follow criminally charging aviation professionals for being responsible for the accidental death of passengers and crew. It clearly demonstrates the need to develop uniform procedures to deal with the issue of criminalization and more importantly, the impediments to aviation safety stemming from the increasing fear of prosecution. There is growing concern in the aviation industry regarding the criminalization of aviation professionals and the negative effect that this has on aviation safety.
