ABSTRACT

Analysis of national adjudication of European Union law is by now a classical play of EU legal scholarship. Effectiveness of application of EU law and ultimately the direction of European integration depends crucially on cooperation with national courts. New MSs upon accession have been faced with the task of integrating the EU legal system into their national legal order and applying EU law thereto. Coherence of the judicial system of application of EU law means that a national legal order that is based on respect for fundamental democratic values has in place a functioning system of rules, procedures, institutions and methods to resolve normative legal conflicts and enforce supranational legal norms. The Estonian Supreme Court has developed a doctrine of interpretation of national law that permits unconditional acceptance of EU law supremacy. Most EU law-related legal disputes adjudicated in Estonian courts did not include a direct clash between national and EU norms.
