ABSTRACT

This chapter outlines the role and functions, the attributes and the ethical responsibilities of the mediator and explains some of the inherent tensions in the mediatory role. The professional skill of the mediator has been seen to lie, ideally, in acting in a manner that reflects an understanding of what has been described as ‘the subtleties’ of respect – ‘acts of recognition and regard that orchestrate the experience of respect’. The main functions of the mediator are those of catalyst and facilitator. Mediators in all fields have devised personal and professional ways of dealing with the consequences of stress arising from their work. There are major ethical responsibilities that the mediator carries. Impartiality is essential to the achievement of the trust that the parties must have in the mediator if that intervention is to be effective. Impartiality vis-a-vis the parties must be distinguished from the separate issue of neutrality.
