Introduction to breach of trust A breach of trust may occur in many different ways. To take three examples encountered in Chapter 11 regarding a trustee’s duties: a trustee makes an unauthorised profit in breach of his fiduciary duty; a trustee does not carry out his duties relating to investment; a trustee purchases trust property. Similarly in Chapter 12, regarding a trustee’s powers, we saw that if a trustee exercises a power improperly, he may be in breach of trust.
