ABSTRACT
Having laid down the constructivist approach to justification and the main methodological steps associated with it in the last chapter, I now turn specifically to the object of investigation, the ECHR. In this chapter, I review, with the aid of seminal historical work, the original context in which the ECHR and the ECtHR came into being, their founding goals as well as their subsequent evolutions.
