ABSTRACT

Legal analysis is the logical process of extracting ideas from numerous legal authorities to form legal opinions. Common law countries have their own advantages, such as flexibility and adaptability in the law. There are many "bad" decisions made by both legislators and judges in common law countries; but a common law lawyer is always ready with an argument to convince a judge to reject past decisions in favor of creating new precedent. Circuit Court decisions courts is left without effective guidance to address future same-sex marriage cases discussion that is not meant to highlight the importance of same-sex marriage as a legal debate. Thus, the American judiciary's use of petit juries in civil cases as well as grand juries in some criminal cases sets it apart in international litigation and poses risks for parties unaware of the risks people face when leaving part of their fate in the hands of ordinary American citizens.
