ABSTRACT

The foundations of law that informed the development of the civil and common law systems are identical. Yet it analyze, interpret, and ultimately argues about that law is fundamentally different. The effect of legal reasoning on the entire legal system in the United States is substantial, and it is largely driven not by legislators or even judges, but by the attorneys that craft effective legal arguments. As amended by the Religious Land Use and Institutionalized Persons Act of 2000 (RLUIPA), RFRA covers "any exercise of religion, whether or not compelled by, or central to, a system of religious belief". Religious employers, such as churches, are exempt from this contraceptive mandate. Health and Human Services(HHS) has also effectively exempted religious nonprofit organizations with religious objections to providing coverage for contraceptive services. Chief Justice Marshall said that "The great object of a corporation is to bestow the character and properties of individuality on a collective and changing body of men".
