ABSTRACT

The purpose of this chapter is to consider how the law of trusts, equity and land law interact. The first section considers the regime introduced by the Trusts of Land and Appointment of Trustees Act (TLATA) 1996 dealing with trusts of land. The previous chapter considered the creation of trusts over the home and disputes about whether or not parties had rights. This chapter considers trusts over land once they have been created and their operation thereafter, as governed by the Act.
