ABSTRACT

The Personal Protective Equipment at Work Regulations 1992 replaced much of the prescriptive requirements of legislation made prior to the Health and Safety at Work etc Act 1974, and implement the requirements of a European Directive. They place duties on both employers and the self-employed. There had long been piecemeal requirements in various statutes, but these have now been repealed or revoked and the present Regulations provide a framework for the provision of PPE in circumstances where assessment has shown a continuing need for personal protection. Generally, a breach of these Regulations can give rise to a civil claim against an employer.
