ABSTRACT

The Confined Spaces Regulations (SI 1997 No 1713) came into force on 28 January 1998, and apply in all premises and circumstances where the Health and Safety at Work etc Act 1974 applies. The Regulations do not apply to work in mines or to diving projects covered by the Diving at Work Regulations 1997. They do not apply to the normal shipboard activities of the crew of a seagoing ship, but where ship and shore workers are working side by side they will apply, and cooperation will be needed to ensure that the requirements of the Regulations are met. The HSE may grant exemptions for a person or space where it is satisfied that health and safety will not be affected by the issue of the exemption.
