ABSTRACT

International treaties and agreements obligate states to take appropriate domestic action to enforce the laws they enact pursuant to international obligations. India’s constitutional provisions mandate that its constituent states foster respect for international law and treaty obligations.1 The scope and ambit of international law in an Indian context has been explained thus:

International law today is not confined to regulating the relation between the states. Scope continues to extend. Today matters of social concerns, such as health, education and economics apart from human rights fall within the ambit of international regulations. International law is more than ever aimed at individuals. It is almost an accepted proposition of law that the rules of customary international law which are not contrary to the municipal law shall be deemed to be incorporated in the domestic law.
