ABSTRACT

This chapter describes the typical process for screening applicants and hiring new employees, and identifies four meanings of affirmative action. It discusses legal requirements regarding the hiring process. Hiring managers who have more than one applicant must discriminate. The word "discrimination" is to choose between or choose among. One meaning of the term "affirmative action" in employment is the removal of barriers. Another meaning is changing managerial attitudes and knowledge to eliminate bias and its effects. The Americans with Disabilities Act of 1990 provides legal protection against employment discrimination to individuals who are disabled. Utilitarianism says that the moral act is the one that creates the greatest good for the greatest number of people. Under the ethical perspective of fairness and justice, the moral act is defined as the one that treats similarly situated people in a similar manner, with regard to both process and outcome.
