ABSTRACT

This chapter discusses the use of traditional paper consignment note and the possible use of electronic documentation and communication at various points. The consignment note is not intended to be a document of title, but merely a method of evidencing the contract, and unlike the bill of lading in relation to carriage by sea it is not intended to facilitate the transfer of title or payment for the goods. The International Road Transport Union (IRU) has drafted a form of consignment note intended to satisfy the requirements of the CMR Convention, a copy of which appears in its amended form in Appendix C of Convention. A particular problem arises where goods are carried in a sealed trailer which is pulled by several carriers. If goods are damaged the last carrier is likely to find himself liable even if he enters a reservation to effect that it was impossible to check the state of goods.
