ABSTRACT

This chapter introduces important concepts and practices in legal issues and organizational structure for the arts venture. It presents a general overview of legal issues for artists and arts organizations. The key concept that distinguishes non-profits from other corporate forms is based on the notion of benefits to society. Establishing a new business requires a number of key decisions, such as the organization’s location, management, and product or service offerings. The sole proprietorship is the simplest, most direct choice for creating a business that is owned by one person. Partnerships are an excellent way to combine talents and resources around a shared vision to help launch and operate an arts organization. Forming a corporation allows an entrepreneur to establish an independent entity for his or her business that is legally distinct from the individual who owns and operates it. Companies use trademarks to establish their brand and make their products or services stand out from the competition.
