ABSTRACT

The term parole means a procedure by which a duly convicted defendant who has been sentenced to a term of imprisonment is allowed to serve the last portion of his or her sentence outside the prison walls, although he or she remains under supervision. The essence of parole is release from prison before the completion of his or her sentence, on the condition that the parolee abide by certain rules during the balance of the sentence. It applies only to cases in which the convicted and sentenced defendant has served part of the imposed sentence. It is a conditional release from confi nement, contingent upon future conduct as set forth in the terms of the parole. The parolee is subject to future confi nement for the unserved portion of his or her sentence in the event that he or she violates the provisions of parole.1
