ABSTRACT

This chapter intends to alert the student to the importance of sales of services in international trade. It focuses on the practical issues that an individual or company faces in hiring foreign personnel. When hiring foreign personnel such as foreign sales representatives it is preferable to hire them as independent contractors than as employees. A foreign sales representative is an agent who distributes, represents, services, or sells goods on behalf of foreign sellers. The chapter reviews the generic ways people sell services-namely the employment, foreign sales representation, and commercial agency contracts. Sales of services are generally effectuated through employment and consulting contracts, which would seem to indicate that these transactions are purely private in nature. The chapter analyses the generic ways people sell services—namely the employment, foreign sales representation, and commercial agency contracts. It concludes with a review of some specific service areas including logistics, advertising, security offerings, and accounting.
