ABSTRACT

Pesticide is a generic term that includes compounds and mixtures. The definition of pesticide encompasses more than those substances whose value is in toxicity to kill pests. Manufacturers must submit accurate and truthful information in support of registration and must keep records on all pesticides manufactured and sold. The registration process for new pesticides is an expensive, multi-year project. Primacy means that the states are the primary point of contact for pesticide use regulation and registration of applicators. State actions against farmers and other pesticide users for violations of pesticide laws constitute the single largest category of environmental violation. The usual distinction is between applicators who apply pesticides in agricultural and forestry uses and those who apply pesticides in buildings. State laboratories meet the chain of custody requirements, and laboratory certification requirements are necessary for the test results to be introduced into evidence in a tort case.
