ABSTRACT
Currently the position is as follows: hearsay evidence is statutorily admissible in criminal proceedings under s 114(1) of the 2003 Act. The statute specifically preserves the common law exceptions to admission of such evidence, by mutual agreement and under the safety valve, i.e. where the interests of justice so require it to be admitted.
