ABSTRACT

This chapter focuses on s 8 orders and how they can be used to manage a parent's relationship with his or her child and the parent exercise of parental responsibility. It also focuses on how the court decides whether to make a s 8 order and will therefore look at how welfare is interpreted. The chapter presents a checklist for students to help them to understand and apply the rules for Private Law Disputes Relating to Children. These include the following concepts: the child arrangement order in Children Act 1989 and how this has replaced the residence order, the child arrangement order and how this has replaced the contact order, contact and domestic violence, and contact and implacable hostility. The chapter also presents three points for debates, a question on an arrangement under the Children Act 1989, the answer to this question and the application of the law.
