ABSTRACT
Many users of the NEC3 contracts believe that the Engineering and Construction Contract is used for larger projects and the Engineering and Construction Short Contract for smaller projects. In the Engineering and Construction Contract there is a prescribed list of items which be included in the Contractor's programme. The payment procedure in the Engineering and Construction Short Contract is different from that in the Engineering and Construction Contract. The Term Service Contract is designed for use in a wide variety of situations where a Contractor is appointed to carry out, as its name suggests, a defined service over a predetermined period of time, referred to in the contract as the 'service period' starting at the 'starting date'. The form and structure of the Term Service Contract is similar to other NEC3 contracts so users will be immediately familiar with early warning, compensation events.
