ABSTRACT

This chapter discusses the concept of military advantage. The issue of whether the anticipated advantage may, in principle, entail operational as well as strategic benefits relates to the discussion of military advantage in the context of an attack 'as a whole'. The chapter explores the meaning of the terms in the definition will take into account the record of negotiations. The Spanish authentic text is the only version of Additional Protocol I to the four 1949 Geneva Conventions (API) that uses the word 'or' to connect the two elements of the definition.
