ABSTRACT
The general and specifi c obligations imposed by the RTC on a Member State relating to CSME competition law are examined below.
8.2.1 Article 9 RTC: ‘General Undertaking on Implementation’
Article 9 RTC, entitled ‘General Undertaking on Implementation’, is central to the achievements of the objectives of the CARICOM Single Market and Economy (CSME) set out in Article 6 RTC. That Article applies to all provisions of the RTC, including those on competition law. It imposes a positive and a negative obligation on a Member State.
