ABSTRACT

Mediation of disputes on large infrastructure construction projects has been discussed and, generally, the presentation style of the dispute is similar to that of Dispute Resolution Boards, which only give opinions rather than make any decisions. However, mediation panels are different in that the mediator works with the parties to have the parties resolve their dispute rather than make or give a ruling or opinion. Mediation Panel gives the opportunity to see the works and to hear the parties' proposals regarding possible settlement of the disputes to be placed before the mediator. It should also state who is representing the party making the referral ifw it is different than the party involved. Following this, it is proper to have an introduction to the project for the benefit of the mediation panel, followed by the details of the dispute and then a section on what exactly is the solution sought from the mediation panel assistance.
