ABSTRACT
There is a subset of agreements that are used in international disputes dealing with complex infrastructure projects, Agreements courtesy of the Dispute Panel Federation, Geneva. The parties choose, prior to any dispute arising, to have the services of either a mediation panel or a specific mediator in place to assist should the need arise. Additionally, in long-term mediation panel work it is helpful to maintain a list of all disputes that have arisen, and to list these by category and type so that the mediation panel can ensure that ultimately all disputes referred to them are resolved. A further document that can be used by mediators either as part of a mediation panel or whilst acting individually is what is known as a 'grouping document'. This proposal provides the categorization of disputes undertaken by Contractor as a means of identifying the potential grouping.
