ABSTRACT

The main focus of freedom from discrimination is based on the economic aspect of employment and sex discrimination. Where the protection of fundamental rights was identified as one of the general principles of (European Union) EU law. The general principle has a wider meaning than merely discrimination based upon sex. This chapter concentrates on the general principle of equal pay for equal work for men and women, laid down in Art 157 TFEU, and the directives issued to provide the detail required for the full implementation of this principle. The Treaty requires Member States not to discriminate on the basis of nationality when dealing with citizens of the EU. This is important because the recent judgments of the CJEU (Court of Justice of the European Union) have stated that whether an individual is a 'worker' is a matter of fact for the national court.
