ABSTRACT

RAPE CASES WERE NOT popular among the assistant prosecutors. Often “she said, he said” affairs, they were tough to win. The office had lost several prior rape cases, and no one minded giving this one to the new guy. The case involved an Ohio State University coed who lived in one of the many rental homes near campus. She was out on her front porch one warm evening during a campus event. A young man walked over and struck up a casual conversation. She didn’t know him but assumed that he was another OSU student. He eventually said that he was thirsty and asked whether she had anything to drink. Without thinking about the risk, she invited him in for some water. He noticed an open bottle of wine in the refrigerator and asked whether he could have some. She agreed and poured him a small glass.
